Dear Mr. Moody:
This responds to your transmittal dated July 24, 1974, of an inquiry regarding the proper location of a gas – oil pipeline constructed in 1965 through a residential area.
This office administers safety standards in 49 CFR Part 192 applicable to the transportation of gas by pipeline, and in 49 CFR Part 195 applicable to the transportation of oil by pipeline, copies of which are enclosed. Both sets of standards contain construction requirements which related to the location of pipelines but do not prohibit routes through residential areas. For example, section 195.210 requires additional cover over pipelines located within 50 feet of a private dwelling. The construction requirements are inapplicable, however, to pipelines existing before 1970, the year Parts 192 and 195 became effective. The standards provide for the safety of these existing pipelines through operating and maintenance requirements and requirements for corrosion control.
