Dear Mayor Erdey:
Confirming our telephone conversation of January 29, 1871, the following answers to your letter
of December 24, 1970, are furnished. The letter of Mr. Hodges of December 29, 1970, enclosing
a copy of your letter was directed to the Hazardous Material Regulation Board, not the Office of
Pipeline Safety in the Department of Transportation and did not reach this Office until January 29,
1971.
Question: Does Title 49 compel small towns to submit such engineering reports?
Answer: Yes. There is no exception to these filing requirements for small systems.
Question: Does your department assist small impoverished towns in filing such reports? If so,
please explain procedure for application of such assistance.
Answer: No. There is no authorization for use of Federal funds for such a purpose. The filing
requirements are simple and do not require any substantial engineering experience. You may wish
to file a basic plan following the requirements of 49 CFR, Part 192, a copy of which is enclosed,
for inspection and maintenance.
Question: Are grants available to assist small municipalities in their utilities departments?
Answer: No.
Question: Are we in compliance with said Act by submitting reports to the Secretary of State,
State of Louisiana?
Answer: No. As stated in Section 192.17(c) of the enclosure, your plan is to be sent to the
Office of Pipeline Safety, Department of Transportation, Washington, D.C. 20590.
