Dear Ms. Johnson:
This is in response to your letter dated October 19, 1999 regarding the compatibility of hazardous materials packaged in the same outer packaging under the Hazardous Materials Regulations(HMR; 49 CFR Parts 171-180). Specifically, you ask if materials described as "Paint, 3, UN1263, PG II" and "Corrosive liquid, acidic, inorganic, n.o.s. (chromic/phosphoric acid), 8, UN3264, PG III- may be packaged in the same outer packaging.
Hazardous materials may not be packed or mixed together in the same outer packaging with other hazardous or non-hazardous materials if such materials are capable of reacting dangerously with each other and causing: combustion or dangerous evolution of heat; evolution of flammable, poisonous, or asphyxiant gases; or formation of unstable or corrosive materials (§ 173.24(e)(4)). Also see § 173.21(e). It is the shipper's responsibility to determine whether any of these dangerous reactions can occur. I hope this satisfies your request.
