Dear Mr. Kawar:
This responds to your February 15, 2013 letter requesting clarification of the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180) applicable to batteries of 9-volts or less. In your letter, you ask if special provision 130 in § 172.102 of the HMR requires batteries of 9-volts or less to have their ends taped provided they are shipped in containers with other batteries that are 9-volt or less and the battery chemistries are packed in separate containers.
The answer is no. When shipping batteries under Special Provision 130, paragraph (d), the spent dry batteries with a rating up to 9-volts sent by highway or rail for recycling, reconditioning, or disposal are not subject to any other requirements of the HMR. This Special Provision does not require the ends of the batteries up to 9-volts to be taped.
