Dear Mr. Wawra:

This responds to your December 1, 2009 request for clarification of the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180). Specifically, you ask if the excepted quantity marking in §173.4a applies to transportation by all modes.

The answer is yes. The excepted quantity marking in §173.4a applies to all modes of transportation. However, excepted quantities of hazardous materials packaged in accordance with this section may not be carried in checked or carry-on baggage aboard aircraft.
