Dear Mr. Jennett:

This responds to your letter dated April 1, 2005, regarding the domestic entry “Sulfur, 9, NA1350, III” in the § 172.101 Hazardous Materials Table (§ 172.101 HMT) under the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).

On December 20, 2004, a final rule [ 69 FR 76044; Docket HM-215G] was published in the Federal Register entitled “Hazardous Materials: Harmonization with the United Nations Recommendations, International Maritime Dangerous Goods Code, and the International Civil Aviation Organization’s Technical Instructions”, incorporating various amendments to the HMR to maintain alignment with the international standards. For the domestic entry “Sulfur, 9, NA1350, III”, an inadvertent error indicated Special Provision “10” instead of”30” in Column 7 of the §172.101 HMT. A correction document under Docket HM-215G will be issued to correct this inadvertent error. Compliance with the amendments adopted in this final rule is not required until January 1, 2006.
