Dear Mr. Baierl:

This is in response to your July 24, 2002 letter regarding the emergency response information requirements.  Specifically, you ask if the emergency response telephone number that you have provided will meet the requirements contained in § 172.604 of the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).

Provided your emergency response telephone number "+1-352-323-3500" is operative and meets the requirements of § 172.604 it will be authorized under the HMR.  You must ensure that the number: 1) is monitored at all times the hazardous material is in transportation by a person who is either knowledgeable of characteristics of the hazardous material and has comprehensive emergency response information, or has immediate access to person who possesses such knowledge (§ 172.604(a)(l)-(2)); 2) includes all necessary area codes or international access codes needed to complete the call from within United States (§ 172.604(a)); 3) is entered on the shipping paper immediately following the description of the hazardous material to which it applies, or if it applies to all hazardous materials on the shipping paper in a visible location with an indication that the number is for emergency response information (§ 172.604(a)(3)(i)-(ii)).

Also, the emergency response telephone number required by § 172.604(a) must be the number of the person offering the hazardous material for transportation or the number of an agency or organization capable of, and accepting responsibility for, providing the detailed information concerning the hazardous material (§ 172.604(b)).
