Dear Mr. Boudin:
This is in response to your letter dated July 31, 2000, regarding whether a non-specification cargo tank used for dry bulk cargo may be used to ship a material described as "Environmentally Hazardous Substances, liquid, n..o.s., Class 9, UN 3082, PG III," under the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).
A material described as "Environmentally Hazardous Substances, liquid, n.o.s., Class 9, UN 3082, PG III" may be shipped in non-DOT specification cargo tank motor vehicles suitable for transport of liquids, as specified in § 173.241 (b). When the HMR authorizes "non-DOT specification cargo tank motor vehicles suitable for transport of liquids, any cargo tank may be used as long as it is able to contain liquids and meets the general packaging requirements in 49 CFR 173.24 and 173.24b.
