Dear Trooper Stone:
This is in response to your letter dated February 8, 2000, regarding the exception for batteries provided in § 173.159(e)of the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180). Specifically, you ask if a transport vehicle loaded with Batteries, wet, filled with acid, 8, UN2794, PGIII and Battery fluid, acid, 8, UN2796, PGIII is eligible for the exception.
The answer is no. Electric storage batteries containing electrolyte or corrosive battery fluid are excepted from the HMR when transported in accordance with § 173.159(e). One of the conditions under § 173.159(e) is that no other hazardous materials may be transported in the same vehicle. This means that with the exception of the batteries, no hazardous materials, including electrolyte or corrosive battery fluid, may be transported in the vehicle.
