Dear Mr. Brock:

This is in response to your September 27, 1995, letter granting a waiver to Consumers Power Company from Rule 321(1) of the Michigan Gas Safety Code to permit the aboveground installation of a 4-inch plastic gas main in a 6-inch steel casing pipe across a bridge in the City of Warren, Macomb County. Rule 321(1) contains the same requirement as 49 CFR 192.321(a) which is that plastic pipe must be installed below ground level. Although our response is beyond the 60 days from written notification as prescribed in 49 U.S.C. 60118(d), we believe that a response should be provided.

We have reviewed the July 19, 1995, waiver application from Consumers Power Company and the Commission's September 21, 1995, order waiving compliance with Rule 321(1). Based on the facts in these two documents, we see no reason to object to the Commission's decision to grant the waiver.
