Dear Mr. Weyel:

 

This responds to your letter dated May 9, 2008, requesting clarification on the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).  Specifically, you ask if the HMR apply to the transportation of hazardous materials to the United States in German military aircraft operated by German military personnel.

 

The HMR apply to the transportation of hazardous materials in commerce.  The transportation of hazardous materials for non-commercial purposes, in foreign military aircraft operated by foreign military personnel, is not subject to the HMR.
