The Chief Counsel's findings were affirmed. Appellant was assessed a civil penalty of $131,454. Appellant may pay the civil penalty in one lump sum OR over the course of 12 months with 12 monthly payments of $10,954.50.00, each month, beginning within 30 days of the date of the Decision, until the entire civil penalty is paid in full. In the Chief Counsel's order, Respondent was assessed a civil penalty of $131,456 for four violations of the HMR when it offered for transportation in commerce a shipment on April 20, 2017 containing hazardous material (UN3480 Lithium ion batteries, 9), without shipping papers, markings, or labels; offered for transportation in commerce a shipment on April 4, 2017 containing hazardous material (UN3480 Lithium ion batteries, 9), without shipping papers, markings, or labels; offered for transportation in commerce a shipment on March 28, 2017 containing hazardous material (UN3480 Lithium ion batteries, 9), without shipping papers, markings, or labels; and offered for transportation in commerce a shipment on January 26, 2017 containing hazardous material (UN3480 Lithium ion batteries, 9), without shipping papers, markings, or labels.
