Respondent was assessed a civil penalty of $9,900 for three violations of the HMR when it offered for transportation in commerce a bulk quantity of Hazard Class 3, Packing Group II hazardous material while failing to develop a security plan; allowed employees to perform a function subject to the requirements of federal hazardous materials regulations when the employees had not received recurrent hazardous materials training in the areas of general awareness, function-specific, safety, security awareness, and in- depth security; and offered for transportation and transported in commerce, a hazardous material, "UN1075, Propane, 2.1," as a private motor carrier, while failing to properly retain copies of shipping papers as required.
