The Pipeline and Hazardous Materials Safety Administration has delegated authority to grant an Emergency Waiver Order to the Hazardous Materials Regulations when the President issues an Emergency or Major Disaster Declaration under the Robert T. Stafford Disaster Relief and Emergency Assistance (Stafford) Act. A listing can be found at the following link: Declared Disasters | FEMA.gov.

An Emergency Waiver may be granted if it is determined:

• it is in the public interest to grant the waiver;
   
• the waiver is not inconsistent with the safety of transporting hazardous materials; and
   
• the waiver is necessary to facilitate the safe movement of hazardous materials into, from, and within an area of a major disaster or emergency that has been declared under the Stafford Act.

State and federal agencies involved in actions to prepare for, respond to, and recover from a threat to public health, welfare, or the environment caused by actual or potential oil and hazardous materials incidents may request an Emergency Waiver Order through specialpermits@dot.gov.

An Emergency Waiver Order may apply to all persons operating under the direction of the recipient if requested.

Note: Emergency Waiver Orders expire after 60 days. If disaster response operations will continue for greater than 60 days, please submit an emergency special permit application under 49 CFR 107.117 as soon as practicable after submitting an Emergency Waiver Order request.
