Appellant was assessed a civil penalty of $17,200 for four violations of the HMR when it transported a hazardous material (UN0161, Powder smokeless, 1.3, PG II), in commerce, that was not properly classified, packaged, marked, labeled, or described in a shipping paper; it transported hazardous materials in commerce without registering as a carrier of hazardous materials; it transported hazardous materials in commerce without developing and implementing a security plan; and it allowed its employees to perform a function subject to the requirements in the HMR, while failing to provide each employee security awareness training and without creating a function specific training record.
