Respondent was assessed a civil penalty of $32,255 for seven violations of the HMR when it offered and transported in commerce an explosive hazardous material, UN 0494, Jet perforating gun, charged oil well, 1.4D, PG II, without first obtaining an approval in accordance with 49 C.F.R. § 173.56; offered and transported in commerce a hazardous material, UN 0454, Igniter, 1 .4S, PG II, when it was not contained in UN specification packaging; offered and transported in commerce a hazardous material, UN 0494, Jet perforating gun, charged oil well, 1.4D, PGII, while failing to properly mark and label the packaging; offered and transported in commerce a placardable quantity of hazardous material, UN 0275, Cartridges, Power device, l .3C, PGII, while failing to develop a written security plan; offered and transported in commerce a hazardous material, UN 0494, Jet perforating gun, charged oil well, 1.4D, PGII, while failing to correctly list all required information on a hazardous material shipping paper; allowed employees to perform functions subject to the HMR when the hazardous material employees had not received current training and testing, and Respondent did not maintain records of hazardous materials training; and offered and transported in commerce a placardable quantity of hazardous material, UN 0275, Cartridges, Power device, 1.3C, PGII, while failing to register with DOT as an offeror and carrier of hazardous materials.
The parties agreed to compromise and settle the case for $13,665.
