Respondent was assessed a civil penalty of $10,000 for two violations of the HMR when it offered for transportation, and transported, in commerce, a hazardous material (UN3257, Elevated temperature liquid, n.o.s., 9, PG III), while failing to have a cargo tank tested or inspected as required; and it allowed an employee to perform a function subject to the requirements of the HMR while failing to provide recurrent security awareness and general awareness training, and failing to properly create and maintain training records; the training records did not include the certification of training and testing per the HMR.
