Respondent was assessed a civil penalty of $15,375 for four violations of the HMR when it filled and transported in commerce a hazardous material, UN1203, Gasoline, Class 3, PG II, and UN1202, Diesel Fuel, Class 3, PG III, in a DOT 406 cargo tank overdue the prescribed periodic tests and inspections, Transporting in commerce a hazardous material, UN1075, Liquefied petroleum gas, 2.1, in a non-DOT/UN standard storage tank designed for permanent installation with the tank charged to more than five percent of its water capacity without a record of inspection; transported in commerce UN1075, Liquefied petroleum gas, 2.1, in a cargo tank motor vehicle (CTMV) without carrying written emergency discharge control procedures for all delivery operations on or within the CTMV; and transported in commerce UN1075, Liquefied petroleum gas, 2.1, in a CTMV required to be equipped with an off-truck remote shut-off device without checking or testing the remote shut-off device within 18 hours prior to the first delivery of each day.
