Respondent was assessed a civil penalty of $10,875 for three violations of the HMR when it failed to perform design qualification drop tests on a UN31A IBC; it failed to notify each person to whom that packaging is transferred with information about the tank and procedures to be followed to effectively assemble and close the packaging for the purpose of preventing leakage in transportation; and it allowed an employee to perform a function subject to the requirements of the HMR, when general awareness/familiarization, function specific, safety, and security awareness training was not provided and records of hazmat training were not maintained, as required.
