Respondent was assessed a civil penalty of $13,000 for five violations of the HMR when it offered a large lithium ion battery, contained in equipment for transportation in commerce, in unauthorized packaging that was not properly labeled or marked according to the HMR; failed to provide a proper hazardous materials shipping paper; and allowed employees to perform functions subject to the requirements of the HMR, while failing to provide each hazmat employee initial general awareness, function specific, safety, and security awareness training.
