Respondent was assessed a civil penalty of $11,775 for three violations of the HMR when it offered for transportation, in commerce, a UN-specification packaging marked in part, "11G/X/****/USA/+BR10407/2040/1130," without repeatable closure instructions; represented, certified, marked, and offered DOT specification packaging as meeting a UN standard when design qualification testing was not performed on an alternative design type, resulting in an unapproved packaging; and manufactured, marked, certified, and offered for transportation, in commerce, DOT specification packaging, marked in part, "UN11G/X/****/USA/+BR10407/2040/1130," as meeting a UN standard, when the design-type was incapable of passing the drop test.
