Respondent was assessed a civil penalty of $100,188 for three violations of the HMR when it manufactured and certified a primary receptacle package to contain infectious substances as capable of withstanding the 95kPa test, when the test was not conducted, therefore falsifying a package as being in compliance with the HMR; and falsified a test report or other grant of authority issued under the HMR; and failed to provide function specific, general awareness, and security training to hazardous materials employees.
