Respondent was assessed a civil penalty of $8,000 for two violations of the HMR when it offered for transportation and transporting in commerce a hazardous material in commerce, while failing to have a DOT specification cargo tank 407/412 tested or inspected in accordance with; and allowed an employee to perform a function subject to the requirements of the HMR while failing to provide initial general awareness and recurrent function-specific training and failing to properly create and maintain training records, per the HMR.
