Respondent was assessed a civil penalty of $43,900 for two violations of the HMR when it filled and offered for transportation, a DOT-3AL specification cylinder, when the required hydrostatic retest had not been performed; and allowed its hazmat employee to perform functions subject to the HMR when the employee had not received the required general awareness, function-specific, or safety training.
