This is in response to your letter dated October 14, 1999, regarding the notification of the Pilot-inCommand of emergency response information under the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180) and International Civil Aviation Organization's Technical Instructions (ICAO). Specifically, you ask whether it is acceptable to include the required emergency response information in a Flight Operations Manual (FOM).
The answer to your question is yes. Korean Air's FOM may contain information equivalent to ICAO's "Emergency Response Guidance for Aircraft Incidents Involving Dangerous Goods" to satisfy the requirements of §§ 175.33 and 172.602, as long as the FOM is accessible to the pilot at all times during flight operations.
Section 175.33, Notification of Pilot-in-Command, requires that the emergency response information required by subpart G of part 172 be maintained in the same manner as the written notification to the Pilot-in-Command during transport of the hazardous material aboard the aircraft. This means that it must be accessible. Section 172.602(b)(3)(iii) of the HMR states that the ICAO "Emergency Response Guidance for Aircraft Incidents Involving Dangerous Goods" or equivalent document may be used aboard aircraft.
