Dear Mr. Constantine:
This is in response to your letter dated August 4, 1972, regarding the waiver granted to Washington Gas Light Company and the Baltimore Gas and Electric Company from the requirements of Section 192.59(a)(1), Section 192.457(b) and Section 192.465(e) of Title 49 of the Code of Federal Regulations.
Regarding your questions concerning the status of the waiver after three years, the Office of Pipeline Safety at that time will evaluate the reports on the results of this type of pipeline rehabilitation. Based on those reports and all other available relevant information, we will then be in a position to determine whether a renewal is justified. Because of the newness of the method and the possibility of unforeseen results, it would be premature for this office now to assure that the waiver will be renewed. However, if the method is successful, and, with other information, supports a renewal of the waiver, this office will at that time consider amending the regulations to permit its use.
