Dear Mr Olsen:

This is in response to your letter regarding the exception covering aqueous solutions of alcohol in § 173150(e) of the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180) Specifically, you ask if the "hazardous material" as used in 173.150(e) means a hazardous material as defined in § 171.8.

The answer is yes. The aqueous solution may not contain any other hazardous material as defined in § 171.8.
