PHMSA Notice of Enforcement Policy Regarding Hazardous Materials Training Requirements for Maritime Workers
The COVID-19 public health emergency has continued to impact the ability of some hazardous materials employers to provide recurrent training for employees as required by the Hazardous Materials Regulations (HMR). As such, PHMSA exercised enforcement discretion for certain hazardous materials training requirements through October 31, 2020. PHMSA understands, however, that certain hazardous materials employers engaged in the maritime transportation of hazardous materials may be continuing to experience difficult in providing the required recurrent training. As a result, PHMSA and the United States Coast Guard will continue to temporarily practice enforcement discretion for any hazmat employer engaged in the maritime transportation of hazardous materials and is unable to provide recurrent training consistent with the HMR due to restrictions resulting from the COVID-19 public health emergency through December 31, 2020.
