Dear Mr. Nelson:

This responds to your letter of July 24, 1976, asking whether or not you are subject to being penalized or fined for failing to comply with the corrosion control requirements of Section
192.457(b) by the August 1, 1976, deadline.

Under Sections 8 and 9 of the Natural Gas Pipeline Safety Act of 1968, any operator of a gas pipeline system that fails to comply with the standards issued under the Act is subject to a civil penalty. Because of this statutory requirement, we are unable affirm that you would not be subject to penalty as you have requested.

It is our policy, however, in enforcing the Federal standards against any operator, to take into account all extenuating circumstances that may bear on an operator's failure to comply with a particular standard.
