Dear Mr. Haines:
This letter is in response to your February 22, 2018, email requesting clarification of the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180) applicable to the requirements for transporting a package under a special permit. Specifically, you ask where a carrier must keep a copy of a special permit for a shipment in reference to Special Permit 20158.
The HMR does not require a carrier to possess a copy of a special permit while the package is in transportation. However, the special permit itself may contain certain modal requirements, including a requirement to carry a copy of the special permit while the package is in transportation. I have consulted with our Approvals and Permits Division, and Special Permit 20158 does not prescribe a specific location within the motor vehicle where the copy of the special permit must be carried.
