Ref. No. 11-0015

Dear Mr. Olson:

This responds to your letter requesting clarification of the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180) applicable to the transportation of nurse tanks. Specifically, you ask whether permitting or approval is required under the HMR for three nurse tanks secured and transported on one trailer that is pulled by a pickup truck or semi-trailer operated by a private motor carrier.

Provided the requirements for nurse tanks specified in § 173.315(m) are met, multiple nurse tanks mounted and secured to a farm wagon that are intended for use in direct support of agricultural operations do not require additional permitting or approval from this Office.

I hope this information is helpful. If you have further questions, please contact this office.

Sincerely,

T. Glenn Foster
