Dear Mr. Carlson:
This is in response to your telephone conversation of November 8, 1973, with Mr. Bill Bertges of our office. You indicated that there was an accident on November 7, 1973, that resulted in a fatality during the construction of a new pipeline. You said that the deceased fell from the pipe-laying tractor and was crushed beneath the tracks. You inquired if even an incident is reportable to our office pursuant to Part 191, 49 CFR.
This will advise that such an incident is not reportable to us because it does not involve a pipeline leak as set forth in §191.1.
