Dear Mr. Bartlett:

This is in response to your December 10, 2002 letter requesting clarification of the requirements concerning smokeless powder for small arms in § 173.171, under the Hazardous Materials. Regulations (HMR; 49 CFR parts 171-180).  Your questions are paraphrased and answered as follows:

Q1. May four UN 4G combination packages, each holding 8 pounds of smokeless powder for small arms, be transported in one UN 4G overpack box?

A1. The answer is yes, provided the 100 pound net mass limitation in § 173,171 (b) is not exceeded.

Q2. May six UN 4G combination packages, each holding 8 pounds of smokeless powder for small arms, be transported in one UN 4G overpack box?

A2. The answer is yes, provided the 100 pound net mass limitation in. § 173.171 (b) is not exceeded.

Additionally, the requirements of § 173.171 (d) do not apply to those packagings authorized under § 173.171 (a), (b) or (c).
