Dear Ms. Yount:

This is in response to your letter dated August 26, 2003, requesting information pertaining to the recent security 'plan requirements under the hazardous materials regulations (HMR; 49 CFR Parts 171-180); Docket HM-232; "Security Requirements for Offerors and Transporters of Hazardous Materials, Final Rule"(68 FR 14510; March 25, 2003). Specifically you ask if the security plan applies to propane shipped in a 2,400 gallon capacity cargo tank motor vehicle.

Yes. The requirements for a security plan apply to those persons who meet the applicability criteria specified in § 172.800.

Also, note the additional security awareness and in-depth security training requirements specified in § 172.704. A copy of the HM-232 final rule, the security awareness CD-ROM, and the Hazardous Materials Safety Pack (including a security guidelines brochure) are enclosed.
